Horvan Edu Coaching
Service terms
The agreement between Horvans and a coaching centre that subscribes to Horvan Edu Coaching, including how Horvans processes the centre's data.
Draft - needs legal review. This text has not been checked by a lawyer yet and may change. Parts in [brackets] are still to be filled in by Horvans. Questions: call +91 99437 08347.
1. Parties
These terms are between Horvans [legal name, type of entity, registered address, PAN/GSTIN if any] ("Horvans", "we") and the coaching centre that accepts them when starting a trial or subscription ("the centre", "you"). The person accepting confirms they may bind the centre.
2. The service
Horvan Edu Coaching is online software for running a coaching centre: batches, students, teachers, attendance, tests and marks, fees and related features. Horvans hosts your centre at a web address of the form /c/<your-address>/. Features may change over time; we will not remove a core feature you rely on without reasonable notice.
3. Accounts and access
Staff, students and parents sign in with their own Horvans account (Google sign-in). The centre decides who is on its list and what role they have, and is responsible for keeping that list correct.
4. Fees and payment
Prices are on the pricing page: a 30-day trial for ₹10 (up to 50 active students and 10 teachers) and ₹20 per active student per month, billed in advance for 30 days on the previous period's highest number of active students, with a minimum of one. [GST treatment - to be confirmed once the GST registration decision is made] Payments are processed by Cashfree Payments.
If the centre takes fees from parents online through its own Cashfree account, those payments go directly to the centre's account; Horvans is not a party to them and does not hold that money.
5. Late payment
If a payment is not made by the end of the paid period (or the trial), the centre keeps full use for 7 days, then becomes read-only, and from day 30 is suspended with data export still available. Paying restores full use. Horvans does not delete data because of late payment.
6. Your data
Everything the centre and its users put into the service ("centre data") belongs to the centre. You can export it at any time from Billing or the centre's settings, including while read-only or suspended.
7. Data processing terms
For centre data, the centre is the Data Fiduciary and Horvans is its Data Processor under the Digital Personal Data Protection Act, 2023. Horvans:
- processes centre data only to provide the service and on the centre's instructions given through the service;
- keeps each centre's data separate from every other centre's and limits staff access to what is needed to run and support the service;
- does not use centre data for advertising and does not place advertising or analytics on the centre's pages;
- uses these sub-processors: [hosting provider (currently Hostinger) and location of servers], Cashfree Payments (payments), [e-mail provider, once chosen];
- tells the centre without undue delay about a personal data breach affecting centre data and helps it meet its obligations;
- keeps encrypted backups [backup frequency and retention - to be confirmed] and deletes or returns centre data when the agreement ends and the centre asks, except billing records that the law requires us to keep.
For the centre's own account and billing details (the people who sign up and pay), Horvans is the Data Fiduciary; see the privacy notice.
8. Students under 18
The centre must obtain verifiable consent from a parent or guardian before adding a student under 18, as the DPDP Act requires, and records that consent in the service. Records of minors without recorded consent are held and not active until consent is recorded.
9. Acceptable use
Do not use the service to break the law, to upload content you have no right to use, to attack or overload the service, or to access another centre's data.
10. Availability and support
We aim to keep the service available at all times but do not guarantee uninterrupted service. Support: +91 99437 08347. [support hours and e-mail - to be added]
11. Liability
[limitation of liability clause - to be drafted by a lawyer]
12. Ending the agreement
You can cancel at any time; it takes effect at the end of the paid period (see the refund and cancellation policy). We may end the agreement for serious breach of these terms after notice. Either way you can export your data first.
13. Law and disputes
[governing law and courts - to be confirmed]
14. Contact and grievances
Phone: +91 99437 08347. Grievance officer: [name], [e-mail address]. Postal address: [address].
